I HAVE BEEN SUED, NOW WHAT DO I DO?!?

 

If you have been sued, this means you have received a Complaint and Summons.  The Complaint must be answered within a specific number of days or you LOSE.  Therefore, it is imperative that you contact an attorney as soon as possible. 

An Answer is a specific document in the accepted legal format indicating whether you admit, deny or do not have enough information to admit or deny the allegations and purported facts of the Complaint.

Often times cases can be settled prior to filing a lawsuit.  Often the first step is to forward to the at-fault person a demand package detailing an initial proposal for settlement.  But often the opposing party will wait until a lawsuit is filed  before they take your claims seriously.  In that case, we will file a formal Complaint, which opens the lawsuit.  

A lawsuit is not something to be taken lightly.  It can take two years or more to go from filing through a jury trial and cost a considerable amount of money.

 

Appeals

If you are considering appealing, it is usually best to seek out an attorney as soon as you have reached the conclusion that an appeal is best. Otherwise, you may miss your chance. Our attorney's handle appeals cases in both federal and state court.
